General Terms and Conditions


Article 1 - Identification of the seller

The current website https://www.idyparis.com (hereinafter referred to as the “Site”) is published by IDY PARIS, a simplified joint-stock company with a capital of 25,000 euros, having its registered office at 98 Boulevard Gabriel Peri, 94350 Champigny-sur-Marne. It is registered in the Créteil Trade and Companies Register under number B 948 863 923, with an intra-community VAT number FR-02948863923.

Article 2 - Purpose, scope and acceptance of the general conditions of sale

The general terms and conditions of sale (referred to as the "GTC") detailed below apply to all orders for products and services made via the Site (referred to as the "Products") by any individual (the "Customer").

The General Terms and Conditions, as well as all contractual information displayed on the Site in French, govern all transactions. The Customer must consult the General Terms and Conditions before placing an order (referred to as the “Order”), these General Terms and Conditions being accessible free of charge on the Site and provided upon request by email or post.

IDY PARIS reserves the right to modify the General Terms and Conditions at any time. The version applicable to any Order is the one in effect on the website https://www.idyparis.com at the time of the Order, with a dated copy available upon request. Placing an Order implies the Customer's full and unreserved acceptance of the General Terms and Conditions in effect on the date of the Order, in accordance with Article 1127-2 of the French Civil Code.

The General Terms and Conditions apply exclusively to sales contracts with consumer buyers and, together with the Online Order, constitute the contractual documents binding on the parties, excluding any other document, prospectus, catalogue or photograph of the Products, which have only an indicative value.

The T&Cs apply exclusively to Products delivered to consumers worldwide.

The buyer (the “Customer”) undertakes not to resell the Products delivered by IDY PARIS.

The invalidity of a contractual clause does not entail the invalidity of the General Terms and Conditions, unless it is a decisive clause which led one of the parties to conclude the sales contract.

The temporary or permanent non-application of one or more clauses of the T&Cs by IDY PARIS does not constitute a waiver of the other clauses, which remain in force.

These General Terms and Conditions take precedence over any other contractual document of the Client.


Article 3 - Products

The Products for sale are those described on the Site at the time of consultation, within the limits of available stocks. This information is automatically updated in real time. However, any update error, whatever its origin, does not engage the responsibility of IDY PARIS. In this sense, IDY PARIS cannot be held responsible for the cancellation of an Order due to a stock shortage.

The Products presented in the Site catalog are each subject to an optional but recommended description, indicating their essential characteristics. Although IDY PARIS takes the greatest care in the presentation of the Products, errors may occur, and the Customer acknowledges this.

IDY PARIS does not guarantee the accuracy or security of the information transmitted via the Site.

It is possible that the Customer may receive a Product previously returned by another person. IDY PARIS only accepts returns of intact and unworn Products, conditions checked before restocking.

Product photos are not contractually binding. Images accompanying the presentation of Products may include items not systematically offered for sale.

The Products and prices remain valid as long as they are visible on the Site, within the limits of available stocks. Errors or modifications may exceptionally occur, in particular in the event of simultaneous orders of the same Product by several Customers. In the event of unavailability noted after payment, IDY PARIS immediately informs the buyer by email or telephone, and offers an equivalent Product or a purchase voucher. In the event of disagreement, IDY PARIS will reimburse the sums paid within a maximum period of fourteen (14) days. Apart from the reimbursement of the unavailable Product, IDY PARIS is not liable for cancellation compensation, except in the event of non-performance of the contract attributable to it personally.

IDY PARIS reserves the right to change the Products offered on the Site at any time. To ensure the quality and availability of its Products, IDY PARIS may limit the quantity that can be purchased per Customer, in accordance with legal provisions, in particular Article L. 122-1 of the French Consumer Code.

By accepting delivery, the buyer acknowledges that the Products received comply with his order and comply with health standards.


Article 4 - Orders and Pre-orders

4.1 - Product Selection

To place an Order or Pre-order, the Customer fills their virtual basket (the “Basket”) by indicating the selected Products and the desired quantities.

The Shopping Cart summarizes the selected Products, with their associated prices and fees. The Customer can view their selection by clicking on the "Shopping Cart" icon in the top right menu, where photos of the Products, their colors and references, the selected quantities, the unit prices and the subtotal appear.


4.2 - Customer identification

After adding the Products to the Cart and before clicking on “Proceed to payment”, the Customer can check the details of their Order or Pre-order, its total price and go back to correct any errors.

The Customer must then provide their email address.

The data recorded by the Site constitutes proof of transactions between IDY PARIS and its Customers. In the event of a conflict, the data recorded by IDY PARIS takes precedence.


4.3 - Validation of the Delivery method

The Customer must confirm their delivery method: either choose shipping by clicking on “Ship”, or opt for direct collection from the IDY PARIS head office by clicking on “Collect”.

By selecting shipping and clicking "Ship," the Customer completes the information required for delivery: first name, last name, address, and phone number. The Customer can also choose to save their contact information for future reference. Once this step is complete, the Customer clicks "Continue to Shipping."

The Customer can then select the shipping method: home delivery by Colissimo, or delivery to a collection point with Mondial Relay. The choice affects the delivery costs and the total amount payable. The delivery area and costs can be changed later.

The Customer can then proceed to payment by clicking on “Continue to payment”.


4.4 - Validation of the payment method and payment of the order

The Customer must enter their bank details. They can use their Delivery address as the Billing address or specify a different one, then click on "Verify Order".

After verification, the Customer can click on "Pay Now" to confirm their Order and pay for it immediately. Confirmation implies acceptance of the General Terms and Conditions and the essential characteristics of the Products.

Although IDY PARIS makes every effort to ensure that the Product photos are accurate, variations may occur. IDY PARIS is not responsible for non-substantial errors in the photographs. For questions about the Products, the Customer may contact IDY PARIS by email at hello@idyparis.com.

For more information on payment terms (currency, accepted methods, etc.), the Customer can refer to article “5. Prices and payment terms”.

Once the Order is completed, it is transmitted to IDY PARIS for processing.


4.5 - Confirmation of order or pre-order

An email confirming the Order or Pre-order and its payment is sent to the Customer by IDY PARIS. This email summarizes the Order or Pre-order (Products, prices, availability, quantities, etc.). The Customer accepts the use of email for confirmation by IDY PARIS of the contents of their Order or Pre-order. The Customer can request the invoice by writing to hello@idyparis.com .

The Client is recommended to keep this confirmation on paper or electronically.

In the event of a Pre-order, the amounts paid in advance are not a deposit according to article 1590 of the Civil Code.

If the minimum objective of a Pre-order campaign is not reached, IDY PARIS will contact the Customer to discuss reimbursement or production.

In the event of a refund, IDY PARIS must proceed within fourteen (14) days after cancellation of the Pre-order.

Any modification of Order or Pre-order after confirmation is subject to acceptance by IDY PARIS.

IDY PARIS reserves the right to refuse or cancel an Order or Pre-Order for legitimate reasons, including abnormally high quantities or prior disputes. IDY PARIS is not responsible for the consequences of incorrect information provided by the buyer.

IDY PARIS may remove a Product from the Site at any time and modify its content. Despite its efforts, IDY PARIS may refuse to process an Order or Pre-order after confirmation has been sent. IDY PARIS is not responsible for any harmful consequences of removing a Product, replacing information on the Site, or refusing to process an Order or Pre-order after confirmation.


Article 5 - Rates and Payment Methods

The sales prices, in accordance with Article L.112-1 of the Consumer Code, are mentioned for each of the products in the electronic catalog in euros, all taxes included, excluding delivery and transport costs indicated before validation of the Order or Pre-order, and invoiced in addition.

All prices displayed are calculated and include the value added tax (VAT) applicable in France if the total turnover of IDY PARIS's distance sales is less than €10,000, or that applicable in the country of delivery located in the European Union if the total turnover of IDY PARIS's distance sales is greater than €10,000.

An invoice detailing the VAT may be sent by IDY PARIS to the Customer, upon simple request from the latter addressed to IDY PARIS.

Except in cases of reimbursement made (i) within the framework of the exercise of the right of withdrawal or for (ii) lack of conformity and hidden defects, IDY PARIS will not reimburse the VAT applied to purchases made on the Site (even in the case where the buyer, after receipt, reships the products to a country outside the European Union).

The total amount owed by the consumer is indicated on the Order or Pre-order confirmation page, along with delivery and shipping costs. The product's selling price is the one in effect on the day the Order or Pre-order is placed.

For sales made outside the European Union, customs clearance and payment of various duties or taxes are the sole responsibility of the Customer and must be paid directly by the Customer to the carrier.

In the event of a price promotion, IDY PARIS undertakes to apply the promotional price to any order placed during the period of advertising for the promotion.

IDY PARIS reserves the right to modify its prices at any time, but products will be invoiced based on the prices in effect at the time of registration and payment of the Order or Pre-order, subject to availability.

IDY PARIS reserves the right to change the price of a product from one Pre-order period to another without this modification having any impact on a Pre-order or an Order already placed.

The price is due in full after confirmation of the order. Payment is made immediately upon Order or Pre-Order by credit card (Carte Bleue, Visa, Eurocard, Mastercard accepted in France) or by Paypal.

The Customer expressly acknowledges that providing their bank card number to IDY PARIS constitutes authorization to debit their account for the price of the products ordered. If applicable, a notification of cancellation of the Order or Pre-order due to non-payment is sent to the Customer by IDY PARIS at the email address provided by the Customer when placing their Order.

Any order placed on the Site implies a guarantee on the part of the Customer that they have all the necessary authorizations to use the means of payment made available on the Site.

The Site is equipped with an online payment security system that encrypts the transmission of the customer's banking data. The Customer's bank card number is sent only to the bank's servers, in a secure environment.

The computerized records, stored in IDY PARIS's computer systems under reasonable security conditions, will be considered as proof of communications, Orders or Pre-orders and payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.


Article 6 - Delivery

6.1 - Delivery Zone

Delivery means the transfer to the Customer of physical possession of the products (the “Delivery”).

Products purchased on the Site can be delivered in France and abroad.

Deliveries are handled by Colissimo or Mondial Relay.

Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residential address of the Customer, of a natural person of their choice or of a legal entity (delivery to their company). For security reasons, IDY PARIS will not process any Order for which a poste restante, a hotel, a PO box or a Cedex address is provided as the Delivery address.

In the event of an error in the wording of the Customer's contact details, IDY PARIS cannot be held responsible for the impossibility of delivering the product(s) ordered.


6.2 - Transport costs

When entering the Order or Pre-order on the Site, the Customer must choose the Delivery method and the place of Delivery.

The amount of the delivery charges is calculated based on the destination and the total weight of the products ordered. These charges are indicated separately before the validation of the Order or Pre-order, and are added to the total amount of the order.

The Customer can opt for standard delivery via Colissimo or Mondial Relay.

IDY PARIS reserves the right to modify shipping costs at any time. However, the costs applied to the order will be those in effect at the time the Order or Pre-Order is validated.


6.3 - Delivery Times

Delivery times depend on the Delivery method chosen by the Customer when Ordering or Pre-ordering.

For standard delivery via Colissimo, delivery times are generally indicated during the ordering process and may vary depending on the destination.

IDY PARIS undertakes to make its best efforts to meet the indicated delivery times. However, delays may occur due to circumstances beyond the control of IDY PARIS.

In the event of a significant delay, the Customer will be informed of the situation by IDY PARIS as soon as possible, and alternative solutions will be discussed, including the possibility of canceling the Order or Pre-order.


6.4 - Delivery Problems

The transfer of risks of loss and deterioration of the Products must be carried out upon Delivery and physical receipt of the Products by the Customer.


6.5 - Receipt of Products

The Customer is required to check the condition of the delivered products upon receipt. In the event of apparent damage, the Customer must notify the carrier of these reservations under the conditions provided for in Articles L.133-3 et seq. of the French Commercial Code.

In the event of non-conformity of the products delivered, the Customer must inform IDY PARIS via the email address  hello@idyparis.com within fourteen (14) days of receipt of the products. The Customer must issue any reservations or complaints with all relevant supporting documents (photos in particular).

In the absence of reservations or complaints made by the Customer within the time limits indicated, the products delivered will be deemed to comply in quantity and quality with the Order or Pre-order.

IDY PARIS declines all responsibility in the event of delay, theft, loss or damage to products during Delivery, except in the event of gross negligence attributable to IDY PARIS.


6.6 - Exercising the right of withdrawal

According to the laws in force, the Customer has a period of fourteen days from receipt of the Products to exercise their right of withdrawal from IDY PARIS. No justification is required, and no penalty will be imposed. This right covers exchange or refund, provided that the Products are returned in their original packaging and in perfect condition, within 14 days of notifying IDY PARIS of the Customer's decision to withdraw.

Returns must be made in their original condition, including packaging, accessories, and instructions. The Customer assumes responsibility in this process, as any damage caused to the Product during return may compromise the right of withdrawal.

Return costs are the sole responsibility of the Customer.

The right of withdrawal can be exercised online using the form available on the Site, with immediate receipt of an acknowledgment of receipt by IDY PARIS. Alternatively, the Customer may express their wish to withdraw by any other unambiguous means.

If the right of withdrawal is exercised within the specified period, only the price of the Products purchased and the delivery costs will be refunded. Return costs remain the responsibility of the Customer. The refund will be made within fourteen days of receipt of the withdrawal decision by IDY PARIS.


6.7 - Delivery Errors

If a Delivery error occurs in relation to the information on the order form, the Customer must report the problem to IDY PARIS customer service on the same day as Delivery or at the latest on the first working day following Delivery. Complaints must be sent by email to the following address:  hello@idyparis.com .

Any claim outside this period will not be taken into account.

In the event of a defect or deterioration of the Product, the Customer must:
• Refuse the package which will then be returned directly to the sender
• Issue handwritten reservations on the delivery slip or transport receipt upon receipt of the damaged package
• Make a complaint on the carrier’s website

The carrier is not required to pay compensation if no reservation is made by the recipient. The recipient's claim will enhance the claim made by IDY PARIS services.

To make a complaint, the Customer must contact IDY PARIS Customer Service by sending an email to the following address: hello@idyparis.com , indicating:

• Recipient's name
• Parcel tracking number
• Order number
• Product designation
• Photos of the damaged package with the postage clearly visible
• Photos of the inside of the package
• Photos of the damaged product

IDY PARIS undertakes to refund or exchange any Products that do not correspond to the Customer's Order. Products must be returned to IDY PARIS in their original condition, with all components (packaging, accessories, instructions) and the purchase invoice.

Return costs will be reimbursed upon presentation of supporting documents.

In any case, these provisions do not affect the Customer's right of withdrawal, as defined in article 6.6.


Article 7 - Returns and Refunds

7.1 - Return conditions for exercising the right of withdrawal

Exercising the right of withdrawal is carried out without additional costs.

As part of the withdrawal process, the Items must be returned in their original packaging, in full (product label, fasteners, buttons), in their initial condition, new, unused, unwashed, unaltered, unsoiled, and accompanied by the purchase invoice or a copy in the event of a partial return.

Returning an Item, in the event of a refund request, is free for Delivery within Metropolitan France. If Delivery takes place outside Metropolitan France and a refund is requested, the return costs are the responsibility of the Customer and are at their own risk.

To initiate a return, the Customer must use the form on the Deliveries and Returns page, enter their personal information (name, postal address, telephone number, email address, order number) and the reason for their return. The Customer will receive by email a Colissimo transport voucher, prepaid by IDY PARIS, in the case of Delivery in Metropolitan France, which they must print. This voucher remains valid for one week. After this period, the return costs are the responsibility of the Customer.

The Customer returns the Order or Pre-order with the prepaid return slip within one week and at the latest within fourteen (30) days following notification of their decision to withdraw in accordance with Article L. 221-21 of the Consumer Code. Beyond this period, the sale is considered firm and final.

Items returned incomplete, damaged, worn or soiled will not be refunded.


7.2 - Reimbursement of Items returned following withdrawal

In the event of a refund request, this will be made within a maximum of fourteen (14) days from receipt of the Item(s) by IDY PARIS. Once the Items have been received, verified and accepted by IDY PARIS services, the refund for the returned Items will be made using the same payment method used when placing the Order. With the express agreement of the Customer, another method may be used, provided that the Customer has previously contacted IDY PARIS Customer Service by email at hello@idyparis.com to notify it. In any event, no additional costs will be charged to the Customer for this refund. The delivery costs of the initial order will not be refunded.

The Customer's bank may apply an additional period of time for reimbursement.

The refund of an order paid for with an e-gift card or credit note will be made automatically in the form of a credit note.

Only the person who ordered the Item can request a refund via the return procedure on the Site, as only their bank account can be credited. The Customer who made the purchase as a gift must follow the return procedure set out in Article 7.1.

It is recalled that the Customer is responsible for the depreciation of the Items resulting from handling other than that necessary to establish their nature, characteristics and proper functioning, following a withdrawal after use.

According to the European Commission, these manipulations are those that a Customer could carry out in a store for goods offered for sale.

The right of withdrawal does not apply to Items made to the Customer's specifications, in particular to custom-made Items.


Article 8 - Guarantees and limitation of liabilities

8.1 - Limitation of liability

Under no circumstances can IDY PARIS be held liable for any damage resulting from a breach of its obligations.

IDY PARIS cannot be held liable in the event of non-performance or poor performance of the contract due to the fault of the buyer, an insurmountable and unforeseeable act of a third party, or a case of force majeure.

IDY PARIS's liability with respect to any Item purchased on the Site is strictly limited to the purchase price of that Item. IDY PARIS shall not be liable for the following losses, regardless of their origin:

• loss of income or sales • operating loss
• loss of profits or contracts • loss of anticipated savings
• data loss
• loss of working or management time
• damage to image
• loss of opportunity, in particular to order an Item
• moral prejudice.

The documents, descriptions and information relating to the Articles appearing on the Site are not accompanied by any guarantee, express or implied, except those provided by law.

IDY PARIS provides no warranty regarding any damage caused by the transmission of computer viruses, worms, time bombs, Trojan horses, cancelbots, logic bombs, or any other programming routine intended to damage, destroy, or otherwise impair the operation of a computer, thereby impairing its proper functioning. The Customer acknowledges its responsibility to install appropriate antivirus and security software on its computer hardware and any other devices to protect against any harmful programs.

The Customer assumes all risks associated with downloading or obtaining any content through the Site and acknowledges that it is solely responsible for any damage to its computer system or any loss of data resulting from the download of such content.

The Items sold by IDY PARIS are subject to the legal guarantees provided for by Articles L. 211-4 to L. 211-13 of the Consumer Code and by Articles 1641 to 1649 of the Civil Code, excluding all other guarantees.


8.2 - Legal guarantee of conformity

IDY PARIS undertakes to deliver to the Customer an Item that complies with the contract and is free from defects of conformity upon delivery, so that the Item is suitable for the usual use of a similar good and has the characteristics mentioned at the time of sale. IDY PARIS is also responsible for defects of conformity related to the packaging.

IDY PARIS may opt to replace the non-compliant Item. If replacement is not possible within one (1) month following the complaint or, if the Customer makes a duly motivated request, the Customer may request a refund of the price of the Item.

This warranty applies provided that the Customer requests it within two years of delivery of the goods. Any lack of conformity occurring within twenty-four (24) months of Delivery shall be presumed to exist at the time of Delivery, unless proven otherwise.


8.3 - Legal guarantee of hidden defects

IDY PARIS will provide the Customer with an Item free from hidden defects that make it unfit for its intended use or that reduce this use to such an extent that the Customer would not have purchased it or would have paid a lower price for it if they had been aware of them. This guarantee only applies if the Customer requests it within two (2) years of discovering the defect.

In the event of a hidden defect, the Customer may choose to return the Item and receive a refund of the price and costs incurred by the sale, or to keep the Item and receive a partial refund. In all cases, it is up to the Customer to prove that they meet the conditions of the warranty.

In the event of a lack of conformity or hidden defects, the Customer must contact IDY PARIS Customer Service by email at hello@idyparis.com and return the Articles to IDY PARIS at the following address:

Items modified, repaired, integrated, or added by the Customer are excluded from the warranty. The warranty does not apply to visible defects that the buyer may have noticed themselves. The warranty does not cover damage occurring during transport after Delivery or resulting from improper use.


8.4 - Force majeure

In the event of the occurrence of a force majeure event preventing the execution of these General Terms and Conditions of Sale, IDY PARIS shall inform the Customer within fifteen (15) days of the occurrence of this event, by email or by registered letter with acknowledgment of receipt. The following are considered to be cases of force majeure or fortuitous events, in addition to those usually recognized by case law: total or partial strikes, lockouts, riots, boycotts, industrial actions or commercial disputes, civil unrest, insurrections, wars, bad weather, epidemics, blockages of means of transport or supply for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes in forms of marketing, computer breakdowns, blockages of telecommunications, including wired or wireless networks, and any other event beyond the control of the parties hindering the normal execution of the contractual relationship. The obligations of the parties are suspended for the duration of the force majeure event, without compensation. If the force majeure event continues for more than three (3) months, the transaction concerned may be terminated at the request of IDY PARIS or the Client without compensation from either party. The Client's failure to pay cannot be justified by a case of force majeure.


Article 9 - Retention of title

IDY PARIS retains full ownership of the Items sold until full payment of the price, including principal, fees, taxes and mandatory contributions.


Article 10 - Intellectual property and processing of personal data

The elements reproduced on the Site are the exclusive property of IDY PARIS and are protected by copyright, trademark law, and unfair competition law. Any reproduction or distribution of these elements without the express authorization of IDY PARIS exposes offenders to legal action.

The automated processing of collected personal data is intended to manage Orders and Pre-orders, possibly for commercial purposes for IDY PARIS only. In the absence of a response, the corresponding order cannot be processed.

In accordance with the Data Protection Act, the Customer has the right to access, rectify and, subject to applicable legal provisions, delete their data; customer service is the data controller, whose contact details are given at the top of these T&Cs.

If the Customer has given their prior consent, they may receive marketing emails or SMS messages from IDY PARIS, from which they can unsubscribe by clicking on the unsubscribe link at the bottom of each email or by sending STOP by SMS. To object to the commercial use of their contact details, the Customer must inform the department responsible for processing.

The processing of personal data, kept by IDY PARIS solely for the proper management of orders and commercial relations, has been declared to the National Commission for Information Technology and Civil Liberties (CNIL).

IDY PARIS assures the Customer that their data is stored within the European Union, particularly in France. The Customer is informed that their login information, including pages viewed and IP addresses, is retained for the legal period of one year.


Article 11 - Miscellaneous provisions

11.1 - Invalid part of the T&Cs

If one or more clauses of these General Conditions of Sale are deemed invalid under a law, regulation or final decision of a competent court, the other provisions will remain in full force and effect.


11.2 - Non-census

No tolerance, inaction or inertia by IDY PARIS will be interpreted as a waiver of its rights under the General Conditions of Sale.


Article 12 - Applicable law, mediation and competent court

This contract and the General Terms and Conditions which govern it are subject to French law.

In the event of a dispute, the Customer is recommended to first contact IDY PARIS customer service electronically at the address hello@idyparis.com or by post to IDY PARIS, 98 boulevard Gabriel Peri, 94350 Champigny-sur-Marne, France.

The Customer is informed that in the event of a dispute with a professional, any consumer has the right to call upon a consumer mediator free of charge to attempt to resolve the dispute. Consumer mediation applies to any national or cross-border dispute between a Customer and a professional in the context of a sales or service contract.

If the complaint request to Customer Service fails or remains unanswered for a period of two (2) months, the Customer has the option of using a consumer mediator listed on the website of the National Chamber of Mediation Practitioners (CNPM) - click here. Or complete the automated complaint form to contact a dispute resolution body (click here).

The request for mediation will not be accepted if:

1° The Customer cannot prove that she first attempted to resolve her dispute directly with IDY PARIS by means of a written complaint in accordance with the terms provided;

2° The request is clearly unfounded or abusive;

3° The dispute has already been examined or is currently being examined by another mediator or by a court;

4° The Client submits their request to the mediator more than one year after their written complaint addressed to IDY PARIS;

5° The dispute does not fall within the jurisdiction of the mediator.

The mediator will inform the Client of the rejection of their mediation request within three weeks of receiving their file.

In the absence of an amicable agreement, the Customer may bring the dispute before the competent court for any dispute relating to the existence, interpretation, conclusion, execution or termination of the contract, as well as for all documents related to this contract. The competent court will be that of the domicile of the defendant or that of the place of actual delivery of the goods or performance of the service.
